Police Officer Passes Stopped School Bus Legally

According to WSAZ, those who enforce the law don’t always comply with those same laws. However, due to a loophole, a West Virginia police officer skirted around his duty to stop for a stopped school bus. 

After the Kanawha County Schools Transportation Department reviewed the surveillance video from the school bus that was carrying elementary students, the South Charleston Police officer caught passing while kids were crossing the road and getting on the bus was doing so legally.

“When you look at the legislative acts that are passed, you can’t over-take a school bus, it doesn’t say anything about behind a school bus,” said Brette Fraley, executive director for Kanawha County Schools Transportation.

The video shows the officer passing the bus driver while it was parked diagonally in the road to pick up students. So technically, under the law, since the officer was on another road, he didn’t illegally pass the bus.

“We shouldn’t be stopping at an angle in the intersection, we either need to be straight ahead or make the left turn and make the stop,” Fraley said.
