No Charges Against School Bus Driver in Fatal Hit-And-Run

WBTV 3 has reported that no charges will be filed in a hit-and-run in which 7-year-old Carlos Octavio Madriagawas killed after being struck by the side mirror of a school bus.

The school bus driver has not been identified but is not driving for the district the rest of the school year. Madriaga was walking along a road when he was struck by the bus.

In a released a statement, the prosecutor in the case asserted that the driver was unaware the mirror had struck the man and many students on the bus were unaware it had hit anything.

To convict, the prosecutor would have to prove the driver knew he hit the pedestrian and kept driving.
